Could Wally Bayola go to jail after his alleged sex tape scandal with EB Babe Yosh Rivera? The Eat Bulaga host may have violated the Family Code of the Philippines, as he is married with five children.

Wally Bayola's alleged sex tape may be used as evidence if the comedian's wife chooses to press charges, though some believe this crime is hard to prove in court. So instead, lawyers may try to nail him on a charge of violence against women and children, which is easier to prove. Presumably the women and children in question would be Bayola's family, whom he indirectly hurt if he had an extramarital affair.
Ironically, Wally Bayola's comedy partner, Jose Manalo, faced a similar scandal. Manalo's wife suspected him of concubinage as well, but she ultimately could not prove her case.
The supposed sex tape of Wally Bayola and Yosh Rivera, a dancer on Eat Bulaga, went viral earlier this week. Neither party has yet confirmed the validity of the video, though Bayola has not appeared on his show since the clip leaked.
A Twitter account supposedly belonging to Jose Manalo confirmed that Wally Bayola was absent from Eat Bulaga because of this alleged sex tape with Yosh Rivera. But Manalo's friend has revealed that the Twitter account in question is fake.
It is unclear exactly how this allegedly Wally Bayola went public. But if the culprit is found, he or she may also face charges.
Parokya ni Edgar frontman Chito Miranda faced a similar sex tape scandal earlier this year, when video of him and his girlfriend, Neri Naig, appeared online. Miranda claimed that someone had stolen his computer hard drive.
Chito Miranda and Neri Naig have already gone to the National Bureau of Investigation. The person who leaked the sex tape could face up to seven years in jail for violating the Anti-Photo and Video Voyeurism Act of 2009.
"What two people do in the bedroom is none of our business so long as it's between consenting adults," said Trixie Cruz-Angeles, former spokesperson for the Integrated Bar of the Philippines. "If they post a video of it, [that's a different matter]," "But when someone illegally uploads a video not intended for public consumption, those two people on the video become victims and deserve, if not sympathy, justice."
